1. Acceptance of Terms

By accessing or using WriterHabits (the "Service"), operated by WriterHabits ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service with a revised effective date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

To access certain features, you must create an account. You agree to:

We reserve the right to suspend or terminate accounts that contain inaccurate or incomplete information, or that we reasonably believe have been compromised.

4. User Content and Intellectual Property

4.1 Your Content

You retain full ownership of all original creative content you create, write, store, or upload on WriterHabits ("User Content"). We do not claim any intellectual property rights over your User Content.

4.2 License to Us

By using the Service, you grant us a limited, non-exclusive, non-transferable, revocable license to host, store, display, and process your User Content solely for the purpose of providing the Service to you (e.g., displaying your writings, calculating progress statistics, sending notifications you have configured).

4.3 Our Intellectual Property

The Service, including its design, features, code, graphics, logos, and documentation, is owned by WriterHabits and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6. Subscription Plans and Payments

6.1 Free and Paid Tiers

The Service offers both a Free Tier and a Paid Tier. The Free Tier provides basic functionality. The Paid Tier provides additional features as described on the Service.

6.2 Billing

Paid Tier subscriptions are billed on a recurring basis (monthly or annually, as selected). You authorize us to charge your designated payment method for recurring fees. All payments are processed through our third-party payment processor (Stripe). We do not store your full credit card information on our servers.

6.3 Cancellation and Refunds

You may cancel your Paid Tier subscription at any time through your account settings. Upon cancellation, you will retain access to Paid Tier features until the end of your current billing period. We do not provide prorated refunds for partial billing periods. We may offer refunds at our sole discretion on a case-by-case basis.

6.4 Price Changes

We reserve the right to change our subscription pricing. We will provide at least 30 days' notice of any price increase. Your continued use of the Paid Tier after the price change takes effect constitutes your acceptance of the new pricing.

7. Writing Groups and Shared Content

The Service allows you to join writing groups and share your content with other users. When you share content with a group:

8. SMS Text Message Notifications

If you opt in to SMS text message notifications (a Paid Tier feature), you consent to receive text messages from WriterHabits at the phone number you provide. Message frequency varies based on your notification settings. Message and data rates may apply. You may opt out at any time by replying STOP to any message or by disabling SMS in your account settings. For full details, see our SMS Notifications page.

9. Notifications and Communications

By creating an account, you consent to receive essential service-related communications from us, including account verification, security alerts, and important service updates. You may configure optional notifications (email and SMS) through the Notifications page. You may unsubscribe from optional communications at any time.

The Service may integrate with or contain links to third-party services, including but not limited to:

11. Content Moderation and Flagging

Users may flag content or comments that they believe violate these Terms. We review flagged content and may, at our sole discretion, remove content or take action against accounts that violate these Terms. We are not obligated to review all content posted on the Service.

12. Termination

12.1 By You

You may delete your account at any time through the Settings page. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

12.2 By Us

We reserve the right to suspend or terminate your account, without prior notice, if you violate these Terms, engage in behavior that harms the Service or other users, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WRITERHABITS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US DURING THE MOST RECENT BILLING CYCLE PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless WriterHabits and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in New Mexico. You consent to the personal jurisdiction and venue of such courts.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and WriterHabits regarding the Service and supersede all prior agreements and understandings.
